The Dun Cow – Takeaway Terms & Conditions

By placing a takeaway order with The Dun Cow, Hornton, you agree to the following Terms & Conditions. These are designed to protect both our customers and our business, ensuring clarity and compliance with applicable law and insurance requirements.

1. Ordering & Acceptance

1.1. All takeaway orders are collection only, unless otherwise stated in writing by The Dun Cow.

1.2. Orders must be placed in advance by phone or email. Online ordering may be introduced in future but is not currently available.

1.3. Orders are not confirmed until accepted by our kitchen team. We reserve the right to decline or cancel any order at our discretion.

1.4. Acceptance of your order constitutes a binding agreement between you (the customer) and The Dun Cow.

2. Availability & Menu Items

2.1. All takeaway items are subject to availability of ingredients and kitchen capacity.

2.2. Menu descriptions are provided in good faith, but ingredients and presentation may vary depending on supply and preparation methods.

2.3. We reserve the right to withdraw or substitute menu items without prior notice.

2.4. Seasonal changes or supplier shortages may affect availability; substitutions will be offered where possible.

3. Collection & Timing

3.1. All takeaways are collection only from The Dun Cow, West End, Hornton, OX15 6DA.

3.2. Collection times are provided as an estimate only. We cannot guarantee that your order will be ready at the stated time due to demand, supply, or operational factors.

3.3. Customers are expected to collect orders promptly. Food not collected within 30 minutes of the agreed time may be disposed of in line with food safety regulations, with no refund given.

3.4. Orders cannot be held indefinitely for late collection.

4. Payment & Pricing

4.1. Payment is due in full at the time of ordering or upon collection, depending on the method used.

4.2. We accept cash and card payments. Card payments are processed securely; we do not store card details.

4.3. All prices include VAT at the prevailing rate.

4.4. Prices may change without prior notice; however, once an order is confirmed, the agreed price will be honoured.

5. Allergens & Dietary Requirements

5.1. Customers must inform us of any allergies or dietary restrictions when placing their order.

5.2. While we take every care, all food is prepared in a kitchen that handles allergens including gluten, nuts, dairy, eggs, and seafood. We cannot guarantee dishes are 100% allergen-free.

5.3. Customers with severe allergies are advised to exercise their own judgment before ordering.

6. Cancellations & Refunds

6.1. Once prepared, takeaway food cannot be refunded or exchanged due to food safety regulations.

6.2. If you wish to cancel an order, please contact us as soon as possible. Cancellations may not be possible once food preparation has begun.

6.3. Refunds will only be issued at our discretion and in line with consumer law.

7. Food Quality & Liability

7.1. We take great care to prepare food to a high standard, but slight variations in appearance, portion size, or cooking time may occur.

7.2. If you are dissatisfied with your order, please notify us immediately at the time of collection so we can attempt to resolve the issue.

7.3. We do not accept liability for food quality once it has been collected and left our premises.

7.4. Food should be consumed promptly. We are not liable for food safety issues if food is not eaten within 1 hour of collection.

8. Insurance & Legal Compliance

8.1. All takeaway operations are covered under The Dun Cow’s public liability and product liability insurance.

8.2. Our kitchen complies with UK Food Standards Agency requirements, including Safer Food, Better Business guidance.

8.3. Nothing in these Terms & Conditions limits our liability for death, personal injury, or fraud arising from our negligence.

8.4. To the fullest extent permitted by law, The Dun Cow disclaims liability for indirect, incidental, or consequential losses arising from takeaway orders.

9. Promotions & Discounts

9.1. Any offers, bundle deals, or discounts are subject to availability and may be withdrawn at any time without notice.

9.2. Promotions cannot be combined unless expressly stated.

9.3. Discounts do not apply to additional extras (e.g. sides, sauces, or premium toppings).

10. Customer Conduct

10.1. We reserve the right to refuse service to any customer who is abusive, threatening, or intoxicated.

10.2. Customers must provide accurate contact details when placing an order.

10.3. Fraudulent orders (including chargebacks) will be reported to relevant authorities.

11. Force Majeure

11.1. We are not liable for failure to fulfil orders due to circumstances beyond our reasonable control, including but not limited to: power outages, supplier failures, extreme weather, or staff illness.

12. Governing Law

12.1. These Terms & Conditions are governed by the laws of England and Wales.

12.2. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
